关于进一步推进本市工程建设项目施工图 设计文件审查改革工作的通知(沪建建管联〔2021〕288号)

各区建设管理(交通)委、卫生健康委、民防办、水务局、绿化市容局,特定地区管委会,各有关单位:

根据国务国务院办公厅《关于全面开展工程建设项目审批制度改革的实施意见》(国办发〔201911号)、上海市工程建设项目审批制度改革工作领导小组《关于印发〈上海市全面深化工程建设项目审批制度改革持续优化营商环境工作方案〉的通知》(沪建审改〔20212号)等文件要求,为进一步推进本市工程建设项目施工图设计文件审查制度改革,落实建设、勘察、设计单位主体责任,提高施工图设计文件审查质量和效率,切实减轻企业负担,现将有关事项通知如下:

一、总体要求

(一)指导思想

深入贯彻落实“人民城市人民建,人民城市为人民重要理念,以习近平新时代中国特色社会主义思想为指导,以推进政府治理体系和治理能力现代化为目标,以更好更快方便企业办事为导向,加大转变政府职能和简政放权力度,结合本市建筑许可营商环境改革总体工作部署,在确保工程建设项目勘察、设计质量的前提下,持续深化施工图设计文件审查制度改革,稳步扩大改革覆盖面,有效推进落实工程建设项目审批四个统一切实增强企业的获得感   。

(二)改革目标

在确保建设工程质量安全底线的基础上,进一步对标国内外城市的先进经验做法,按照突出重点、分类管理,强化责任、严格监管的原则,探索建立健全基于不同风险等级的施工图设计文件审查差别化管理模式

    (三)改革内容

        循序渐进地推进施工图设计文件审查分类改革,落实建设、勘察和设计单位的主体责任,加强事中事后监管,持续优化和提升营商环境。在本市社会投资低风险产业类项目取消建设单位委托施工图设计文件审查,调整为事中事后监管的基础上,将改革范围进一步拓展到全市产业类项目以及规模以下的公共建筑项目、低等级市政道路、小型泵站工程、绿化及泵闸工程配套用房等项目。

二、改革举措

(一)实行分类管理

在本市新建、改建、扩建的房屋建筑和市政基础设施工程中实行施工图设计文件审查分类管理。根据项目类型、建设规模、技术难度等因素,建立施工图设计文件免于审查正面清单(详见附件)。

清单范围内的项目,实行勘察单位、设计单位书面承诺制,施工图审查合格证书不再作为建设工程施工许可证核发的前置条件。

清单以外的项目,仍按本市有关规定严格执行施工图设计文件多图联审制度。

(二)加强事中事后监管

 列入清单范围内的项目,根据市、区分工原则,市、区建设管理部门、特定地区管委会统一通过政府购买服务的方式,委托经市住房城乡建设管理委认定的施工图审查机构对施工图设计文件进行全覆盖质量检查。

(三)规范质量检查时限

列入清单范围内的项目,被委托的施工图审查机构应当在项目取得施工许可证后规定的时限内,按照现行规范标准和管理要求,完成施工图设计文件质量检查。其中:

产业类项目:建筑面积1万平方米及以下的项目,在施工许可核发后的3个工作日内完成检查; 建筑面积 1万至5万平方米(含5万平方米的建设项目,在施工许可核发后的  7个工作日内完成检查;建筑面积大于5万平方米的项目,在施工许可核发后的10个工作日内完成检查。

公共建筑项目:在施工许可核发后的3个工作日内完成检查。

城市支路项目:在施工许可核发后的5个工作日内完成检查。

小型给水、排水泵站项目:在施工许可核发后的5个工作日内完成检查。

水利泵闸项目、绿化项目配套用房:在施工许可核发(或完成开工备案)后的3个工作日内完成检查。

(四)在线出具检查结果

质量检查合格的,施工图审查机构应当在上海市工程建设项目审批管理系统(以下简称审批管理系统上在线出具检查合格书,并对检查合格的电子图纸及相关资料进行数字签章。施工图审查机构出具的检查合格意见视作相关管理部门检查合格意见。

质量检查不合格的,施工图审查机构应当在审批管理系统上在线出具明确的检查不合格意见,说明不合格原因并提出限期整改意见。整改后的施工图设计文件需重新上传审批管理系统进行复查。

未在整改期限内完成的项目,由建设管理部门或交通、水务、绿化市容等部门依法责令建设单位停止施工或使用,上述行为作为不良行为计入失信记录。建设单位整改通过并取得质量检查合格意见后,方可重新开工。

三、保障措施

(一)落实主体责任

全面落实勘察、设计单位及从业的专业技术人员对施工图设计的主体责任,确保设计文件质量。在要求企业加强自身内部管控的同时,市住房城乡建设管理委会同市交通委、市民防办、市水务局、市绿化市容局等部门,细化完善施工图审查事中事后监管措施,推动本市施工图设计文件审查改革工作纵深发展。

(二)健全信用评价机制

市住房城乡建设管理委制定本市在沪勘察设计企业信用评价管理办法,根据不良信用信息建立勘察、设计质量行为“黑名单,在事中事后监管等活动中对相关企业和个人实施惩戒性差别化管理,相应增加抽查频次,并根据信用制度采取限制市场准入、限制招投标等措施,严格落实勘察设计的主体责任,切实保障工程建设项目的质量和安全。

(三)优化施工图审查内容

根据国务院全面开展工程建设项目审批制度改革要求,重点聚焦结构安全、建筑防火、建筑环境等安全审查,探索优化、限定施工图审查内容。结合住房城乡建设部施工图技术审查要点修订,对照地方标准修编完善本市施工图设计文件审查要点。

(四)探索推行智能审查

进一步优化审查方式,探索推进施工图智能化审查。依托审批管理系统,研究开发基于BIM技术的一站式建设管理智能化审批功能,健全统一的规则库和数据交互标准,形成基于BIM技术的审批体系,探索实施三维模型及导出的施工图设计文件自动审查及审核监管,推进施工图审查由审核图纸向审核模型过渡。

(五)加强经费保障

施工图设计质量的检查费用,由市、区建设管理部门和各特定地区管委会支付,原则上每季度结算一次,所需资金应列入部门预算。其中,市级部门的检查费用,在市勘察设计管理中心事中事后检查专项经费中列支。

Circular on Further Promoting the Reform Work of the Review of Construction Drawings andDesign Documents of Engineering Construction Projects in Shanghai

 

 

All districts’ constructionadministration (transportation) commissions, health commissions, civil defense offices,water bureaus, landscaping and city appearance bureaus, administrative committeesof specific areas, the relevant agencies:

In pursuant with the requirements of ImplementationOpinions of the General Office of the State Council on Full-Scale Launch ofReform of the System of Review and Approval of Engineering ConstructionProjects (G.B.F. [2019] No.11), Circular of the Shanghai MunicipalLeading Group of the Reform Works of Review and Approval System forConstruction Projects on Printing and Issuing the Work Plan of the ShanghaiMunicipality for Comprehensively Deepening the Reform of Review and ApprovalSystem for Construction Projects and Continuously Optimizing the BusinessEnvironment, and other relevant documents, to further promote the reform ofthe review system of construction drawings and design documents of engineeringconstruction projects in Shanghai, to strengthen the accountability of project owners,geotechnical study companies, design companies, to improve the quality and efficiencyof the review of construction drawings and design documents, and to ease theburden on the market entities in a tangible way, hereby we notify you of the relevantmatters as follows:

I.             Overall requirements

(I) Guiding thoughts

For implementingthe important concept of “the city is built by the people, the city is for the people”in depth, taking the Xi Jinping Thought on Socialism with ChineseCharacteristics for a New Era as guidance, with the goal of promoting themodernization of governance system and capability of the government, with the directionof facilitating a better, faster, and more convenient business environment, we willkeep transforming government functions, streamlining administration, anddelegating power. Taking into consideration the overall work deployment of the reformof business environment of dealing with construction permits in Shanghai, under the premise of ensuringthe quality of geotechnical study and design of construction projects, we will continueto deepen the reform of the review system of construction drawings and designdocuments, steadily expand the coverage of the reform, effectively promote theimplementation of the "four unifications" of the review and approval system of constructionprojects, and tangibly enhance the sense of rewarding of the enterprises.

(II) Reform goals

Under the premise of ensuring the quality and safety baselineof construction projects, we will further benchmark against the advanced experience and practicesof cities in the world, with the principle of "highlighting priorities, differentiatedmanagement, strengthening responsibilities, and strict supervision", explore to establish andimprove the risk-based differentiated management model for the review ofconstruction drawings and design documents.

  (III) Contents ofthe reform

    We willgradually push forward the reform of the differentiated review of constructiondrawings and design documents, require construction, geotechnical study, anddesign entities to assume their responsibilities, strengthen interim-and-ex postsupervision, and continuously optimize and enhance the businessenvironment. We shall eliminate the owner-commissioned review of constructiondrawings and design documents of low-risk industrial projects with private investmentsin the Shanghai municipality, adjust to the adoption of interim-and-ex-post supervision,and based on this, we further expand the scope of reform to all industrial projects,and public buildings, low-grade municipal roads, small-scale pumping station projects,supporting houses to landscaping and pumping gate projects, and other projects belowcertain scale.

II.           Reform measures

(I) Implementingdifferentiated management

We shall adopt the differentiated management approachto the review of construction drawings and design documents of new, alteration,or expansion building projects and infrastructure projects in the Shanghai municipality.According to the factors such as project type, project scale, technical difficulties,etc., we shall establish the positive list of projects that can be exempt from thereview of construction drawings and design documents (Please refer to the appendixfor details).

For projects within the scope of list, we adopt the writtencommitment system on geotechnical study companies and design companies, and thecertificate of construction drawing review shall no longer be used as a prerequisitefor the issuance of construction permits for construction projects.

For projects beyond the scope of list, we still adoptthe system of “joint review of construction drawings and design documents of multiplespecialties” in accordance with the relevant provisions of the city strictly.

(II) Strengthening interim andex-post supervision

 For projects within the scope oflist, in accordance with the principle of the division of work, the municipaland district construction administration departments, and administrative committeesof special areas commission the full-coverage review of the quality of constructiondrawings and design documents to the construction drawing review agencies authorizedby the municipal housing and urban-rural development through the way of unifiedgovernment procurement.

(III) Standardizing the time limits for quality review

For a project within the scope oflist, a commissioned construction drawing review agency shall complete thequality review of construction drawings and design documents in accordance witheffective codes, standards, and management requirements, within the stipulatedtime limit after the project obtaining its construction permit. The specifictime requirements are as follows:

Industrial projects: for a project with a construction area of 10,000m2 or below, the review shall be complete within 3 working days after theconstruction permit is issued;for a projects with aconstruction area between 10,000m2 and 50,000m2 (including 50,000m2), the review shallbe complete within 7 working days afterthe construction permit is issued;for a projects with a construction area greater than 50,000m2, the review shallbe complete within 10 working days afterthe construction permit is issued.

Public building projects: the review shall be complete within 3 working days after theconstruction permit is issued.

Urban branch road projects: the review shall be complete within 5 working days after theconstruction permit is issued.

Small-scale water supply and drainage pumping station projects: the review shall be complete within 5 working days after the constructionpermit is issued.

Supporting houses to pump gates of water resources projects or landscapingprojects: the review shall be complete within 3 working days after the construction permit is issued (or filing of the commencement of construction).

(IV) Issuing online the review result

Where construction drawingsand design documents of a project pass the review, the construction drawing reviewagency shall issue online the review certificate on the Shanghai Construction Projects Review and ApprovalManagement System (hereinafter referred to as the "Review and Approval Management System"), and digitally sign and stamp the electronic drawings and related documents. The reviewopinions of the construction drawing review agencies shall be deemed to be the reviewopinions of the relevant administrative departments.

Where the construction drawings and design documents of a project fail the review, the construction drawingreview agency shall issue online a clear nonconformityreview opinion, indicating what requirements the documents have failed to meet,the rectification opinion, and the specific time to complete the rectification.The rectified construction drawings and design documents should be resubmitted tothe Review and Approval Management System for review once again.

Where a project fails to rectify within the prescribed time, the constructionadministration department or transportation, water works, landscaping departmentsshall legally order the project owner to cease the construction or occupancy, andsuch misbehavior shall be counted as bad credit record. Only does a project owner’srectification pass the review and a review certificate is issued, the owner mayrestart the construction work.

III.         Safeguarding measures

(I) Requiring the entities to assume theirresponsibilities

We will fully require the entities including geotechnical study companies, designcompanies and their professional technicians to assume their responsibilities toensure the quality of design documents. In addition to requiring the entities toimprove their internal management and control, the Municipal Commission of Housingand Urban-rural Development, together with the Municipal Commission of Transportation,the Municipal Civil Defense Office, the Municipal Water Authority, the MunicipalLandscaping and City Appearance Bureau, etc., shall improve the detailed interimand ex-post supervision measures for the review of construction drawings and designdocuments, and deepen the reform work of the review of construction drawings anddesign documents in the city.

(II) Ameliorating the credit evaluation mechanism

The Municipal Commission of Housing and Urban-rural Development shall formulatethe measures for credit evaluation of geotechnical study and design companies whoare doing business in Shanghai, establish a blacklist of quality behaviors occurredin the geotechnical study and design business based on the bad credit information,implement the punishment-based differentiated administration of the related entitiesand individuals during the interim and ex-post supervision, such as increasing therandom reviews, restriction on market access, tender and bidding activities, andother measures, according the credit mechanism, to strictly require the market entitiesof geotechnical study and design trade to assume their responsibilities, and toeffectively ensure the quality and safety of construction projects.

(III) Optimizing the contents of the constructiondrawing review

In accordance with the requirements of the State Council to carry out the full-scalereform of the review and approval system for construction projects, we focus onsafety reviews such as structural safety, building fire prevention, buildingenvironment, etc., explore to optimize and limit the contents of review. Based onthe revision of the key technical review points of construction drawings by theMinistry of Housing and Urban-rural Development and the revision and formulationof local codes, we shall develop the municipal key technical review points of constructiondrawings.

(IV) Exploring the promotion of intelligent review

We will further optimize the review methods, explore the promotion ofintelligent review of construction drawings. Relying on the Review and ApprovalManagement System, we will research and develop one-stop construction administrationintelligent review and approval function based on BIM technology, improve the unified database of rules and standards of datainteraction, to form a BIM technology-based review and approval system. We will explore theimplementation of automatic review and supervision of 3D models and exported constructiondrawings and design documents, promoting the transition from the review of constructiondrawings to the review of models. 

(V) Safeguarding the funds

The review cost of design quality of construction drawings shall be coveredby the municipal and district construction administration departments and the administrativecommittees of special areas, and shall be settled on a quarterly basis in principle.The required funds shall be included in the departmental budgets, among whichthe review costs of municipal departments shall be included in the special fundof interim and ex-post supervision in the Municipal Geotechnical Study and DesignAdministration Center.
